Mitigation Banking

The Corps of Engineers issues permits/verifications under Section 404 of the Clean Water Act for projects that will impact jurisdictional waters of the U.S. (WoUS), including rivers/streams and wetlands. Compensatory mitigation is required to offset project-related impacts to WoUS. In the past, most mitigation projects were permittee-responsible and performed on or near the WoUS impact site. As outlined in the 2008 Compensatory Mitigation Rule, the Corps would now prefer to see WoUS impacts compensated for within a mitigation “bank”. Ms. Greer will briefly discuss current and proposed mitigation banking options.
Ms. Greer has worked in the regulatory office of the Corps of Engineers for 10 years, including 7 years in New Orleans and 3 years in Denver.
